These kinds of terms and conditions are omnipresent, in anything that has T&C’s, such as product warrantees, apps, bank deposits, and even in sweepstakes and on line contests. Essentially, once these terms of adhesion became common, the right to a civil trial or joining a class action is being eliminated. I think a part of it is corporate self defense due to the crazy multimillion dollar suits for trivial things (coffee heat, soup ads, etc.).
They are contracts of adhesion and they are ubiquitous.
I shed no tears for the corporate giant.
